1. Acceptance of Terms

By accessing or using TinyAsk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). TinyAsk is a product by Aidia ApS. If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

TinyAsk is a survey platform that allows you to create, distribute, and analyze surveys. The Service includes web-based tools for survey creation, data collection, and analytics. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Transmit any harmful, offensive, or illegal content
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for spam, phishing, or other fraudulent activities
• Collect or harvest information about other users without their consent
• Use automated systems to access the Service in a manner that sends more requests than a human could reasonably produce

5. User Content

5.1 Ownership

You retain ownership of all content you create, upload, or submit through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display your User Content solely for the purpose of providing and improving the Service.

5.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or that we determine is harmful, offensive, or otherwise objectionable, without prior notice.

6. Payment and Billing

6.1 Subscription Plans

The Service may offer various subscription plans with different features and pricing. By subscribing to a paid plan, you agree to pay the fees associated with that plan.

6.2 Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually, as selected). You authorize us to charge your payment method for all fees. If payment fails, we may suspend or terminate your access to paid features.

6.3 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are provided in accordance with our refund policy, which may vary by jurisdiction.

7. Fair Use Policy

7.1 Response Limits

While responses are unlimited on the Pro plan, this is subject to fair use terms. We implement a monthly soft limit of 50,000 responses per account. This limit is designed to ensure fair usage of our infrastructure and maintain service quality for all users.

If you approach or reach this monthly limit, we will reach out to discuss an updated pricing proposal that better aligns with your usage needs. This is a soft limit, meaning we will not automatically suspend your service, but we may contact you to discuss scaling options.

7.2 Spam Prevention

We implement various mechanisms to prevent and mitigate spam, including but not limited to:

• Rate limiting and automated detection of suspicious activity patterns
• IP address tracking and blocking of known spam sources
• Behavioral analysis to identify bot traffic and automated submissions
• Content filtering to detect and prevent malicious or fraudulent submissions

In scenarios where a survey form is being deliberately spammed by customers, bots, or other automated systems, we reserve the right to take protective measures including but not limited to: blocking specific IP addresses, temporarily suspending survey collection, or requiring additional verification steps. We are not liable for any spam submissions that may occur, and we encourage users to implement their own spam prevention measures where appropriate.

If you believe your survey is being targeted by spam or abuse, please contact us immediately so we can assist in implementing additional protective measures.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by TinyAsk and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your information.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent, abusive, or illegal activity
• Non-payment of fees
• Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by contacting us or using the account deletion feature.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIDIA APS AND TINYASK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold harmless Aidia ApS, TinyAsk, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your User Content, or your violation of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Denmark.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
